1. Purpose

This policy outlines Wesley College’s commitment to meeting the requirements of Standard 7 of the National Code 2018, which regulates the transfer of international students between registered providers. It sets out the College’s approach to managing international student transfer requests in compliance with the Education Services for Overseas Students (ESOS) Act 2000 and the National Code 2018 (Standards 7.2, 7.5, and 7.6).

2. Definitions
  • Principal Course: The main course of study undertaken by an International student
  • Registered Provider: A provider approved by CRICOS to offer courses to overseas students
  • Letter of Release:To enable the student to enrol with another provider of their choosing
3. Policy Statement

Wesley College is committed to acting with integrity and ensuring compliance with the ESOS framework. In accordance with Standard 7, the College will not knowingly enrol or actively recruit an overseas student currently enrolled with another CRICOS-registered provider before the student has completed six months of their principal course, unless:

  • The transfer is permitted under Standard 7 exemptions (e.g. provider default, course cessation, exceptional circumstances)
  • The student has completed the required six-month study period
  • A valid letter of release is provided

Wesley College upholds the best interests of students while balancing compliance, academic integrity, and the sustainability of their learning journey.

4. Recruitment and Enrolment Procedures
  • All applications will be checked against PRISMS to verify enrolment history and status
  • Admissions staff and authorised agents must not encourage or facilitate transfers that breach Standard 7
  • Any application raising compliance concerns will be escalated to the Head of Admissions for review, with oversight from the Director of Community Engagement
4.1 Transfer to another provider (Standard 7,2)

Wesley College will allow a transfer after a student has completed six months of their principal course. Before this period, transfers may be approved if:

  • That the overseas student will be reported because they are unable to achieve satisfactory course progress at the level they are studying, even after engaging with that registered provider’s intervention strategy to assist the overseas student in accordance with Standard 8 (Overseas student visa requirements)
  • When the registered provider fails to deliver the course as outlined in the written agreement
  • When there is evidence that the overseas student’s reasonable expectations about their current course are not being met
  • When there is evidence that the overseas student was misled by the registered provider or an education or migration agent regarding the registered provider or its course and the course is therefore unsuitable to their needs and/or study objectives
  • When an appeal (internal or external) on another matter results in a decision or recommendation to release the overseas student.

If a release is granted, it will be at no cost to the overseas student, and Wesley College will advise the overseas student to contact Immigration to seek advice on whether a new student visa is required. (Standard 7.4)

Transfer requests may be refused if:

  • The transfer is not in the student’s best academic or personal interest
  • The student has not accessed College support services
  • The transfer appears motivated by attendance, behaviour, or progress concerns
  • The student has outstanding fees or other obligations

In all cases, students will receive written reasons for refusal and information about their right to appeal.

4.2 Transfers from another provider (Standard 7.5)

Wesley College will not enrol a student currently enrolled with another CRICOS-registered provider unless:

  • The student has completed six months of their principal course, OR
  • The transfer is permitted under Standard 7 exemptions (e.g. provider closure, cancelled course, valid release letter, visa conditions)

All transfer requests will be checked through PRISMS for compliance.

4.3 Complaints and Appeals (Standards 7.6 and 10)

If a transfer request is refused:

  • The student will receive written reasons for the refusal
  • The student will be informed of their right to access the College’s internal complaints and appeals process within 20 working days
  • During this period, the student’s enrolment will be maintained, and the decision will not be finalised in PRISMS until:
  1. The appeal process concludes and supports the College’s decision, OR
  2. The student does not lodge an appeal within 20 working days, OR
  3. The student withdraws their appeal in writing

Students unsatisfied with the internal process may escalate to the Overseas Student Ombudsman or relevant authority.

4.4 Transfer Request Procedure

To transfer to another provider:

  1. Submit a written request with reasons and supporting documentation
  2. Provide an offer letter from the receiving provider
  3. If under 18, include parent/guardian approval and welfare arrangements
  4. The College will assess the request within 10 working days

To transfer from another provider to Wesley College:

  • Admissions staff must verify course and visa details through PRISMS
  • Enrolment may only proceed if fully compliant with ESOS requirements
5. Records and Reporting

All transfer applications, correspondence, decisions, and appeal outcomes will be recorded on the student’s file and reported through PRISMS where required.

6. Staff and Agent Responsibility

All staff and education agents involved in international enrolments must be aware of and comply with this policy. Breaches may result in disciplinary action or termination of agency agreements.

7. Supporting Documents
